This document serves to notify the Boarding facility listed above (hereinafter referred to as “Facility”) where said horse,______________, is boarded, that Bright Futures Farm, Inc. is the owner of said horse on paper.  The individual listed herein as Boarder has adopted said horse, from Bright Futures Farm, Inc.

 

While we do not anticipate any problems between Facility and the adopter of said horse, this document serves to address several items that could arise.  Please be advised that should Boarder become more than 30 days late in payment of board for said horse, and Facility intends to evict boarder, place a lien against said horse or sell said horse for back board, Facility agrees to notify Bright Futures Farm, Inc. in writing of the circumstances regarding Boarder and understands that said horse cannot be sold, evicted, or have a lien placed on him/her by Facility.  Upon written notification from Facility, Bright Futures Farm, Inc. will remove said horse as soon as transport arrangements can be made to alleviate further burden on Facility.  While Bright Futures Farm, Inc. will remove said horse within 30 days (and often much sooner) upon written notice from Facility, it must be understood that Boarder is responsible for any and all money due to facility, damages experienced that are directly or indirectly related to Boarder or said horse and cost of same (see paragraph five).  Facility understands that Bright Futures Farm, Inc. has no financial obligation to Facility.  Bright Futures Farm, Inc. understands that boarders are sometimes late with payments, and facilities are sometimes lenient in that regard.  However, if this situation is an ongoing problem, and the welfare of said horse is at risk,  it is imperative that Facility contact Bright Futures Farm, Inc. immediately, in writing to remove said horse.

 

 

 

 

 

Should Boarder be in contract with Facility for partial board, and Boarder is somewhat or entirely responsible for the care of said horse, Bright Futures Farm, Inc. asks that Facility notify Bright Futures Farm, Inc. if said horse is not receiving proper care that Boarder is responsible by contract with Facility, to provide.  At that time, Bright Futures Farm, Inc. will address the concerns with Boarder to remedy the situation and improve the conditions for said horse, or make arrangements to remove said horse.

 

Please be advised that should a dispute in payment arise regarding said horse, said horse is NOT  to be sold or transferred by Facility or any other individual/entity.  Bright Futures Farm, Inc. should be contacted immediately and upon such notification, will promptly take the appropriate steps (mentioned in paragraph two, page one of this document) to move said horse as quickly as possible to alleviate further burden on Facility.  It is up to the owner/manager of the Facility to determine when to contact Bright Futures Farm, Inc. keeping in mind that Bright Futures Farm, Inc. will provide no remuneration to Facility for any monies owed by Boarder.  Boarder has the financial arrangement with Facility.

 

If Bright Futures Farm, Inc. is asked by Facility to remove said horse from the premises, Boarder immediately surrenders all rights to said horse and can no longer take part in any activity with said horse from that day through our removal of said horse from Facility even if Boarder has paid board beyond the date Facility has contacted Bright Futures Farm, Inc.  If Boarder is providing partial care/feed/turnout, Boarder will however be responsible to continue to provide that care if Facility refuses to do so.

 

Furthermore, should a dispute arise between Boarder and Facility that involves anything other than basic board, Boarder is solely responsible for resolving that dispute with Facility ( supplements, farrier, dentist, damage, etc.),  Bright Futures Farm, Inc., Beverlee Dee, their/her associates, affiliates, assigns, successors, et al are held harmless for any and all of additional monies and/or damages in question.

 

And, finally, please be aware that although ownership of said horse does NOT transfer to the adopter/fosterer, full liability DOES on the date the the horse leaves Bright Futures Farm.  Bright Futures Farm, Inc. encourages adopters to purchase both health and liability insurance for the horse they choose.  Bright Futures Farm, Inc. feels insurance is a healthy financial investment of a minimal amount to ensure that the horse is properly cared for when a major health issue arises, and the adopter/fosterer is protected should any accidents occur.

 

Bright Futures Farm, Inc., Beverlee Dee, their/her agents, affiliates, employees, representatives of all types, officers, Directors, their successors and assigns, et al is/are held harmless from liability in the event of an accident and/or incident and/or property damage and/or death involving said horse (directly or indirectly) while said horse is under the care of boarder and/or Facility.

 

If you, the facility owner, have any questions regarding this document, please contact Beverlee Dee at 814-827-8270.  We do not anticipate a problem, but must protect the adopted horse should a problem arise.  Thank you for understanding.
